2. Make a Contract
2.1 When you wish to purchase any of the product in our collections, please contact us via email email@example.com, by phone +44 7758 960 242 or via social media (Facebook, Instragram or Youtube @motivumfashion).
2.2 We will discuss your order requirements, specifications, sizes, measurements, and any other details to fulfill your customised item as you wish. We might also need to ask you to try on the piece of clothing in person.
We will make sure to meet your requests as best as we can.
2.3 In some cases, especially if your order has to be custom made, we will request you to send advanced payment to secure your order and help us to purchase the materiel and start the hand-made work.
In such cases, we will notify you in advance and invoice you as appropriate.
2.4 In the unlikely event that we are not able to fulfil your order, we will notify you via email and agree with you how to amend the order in order to fulfil it as best we can.
2.5 As we are creating unique items, it is likely that this only one piece of clothing is available at only one size and design.
Our aim is to make sure that you enjoy your item’s uniqueness, bespoke quality and luxury in the longest term possible as our aim is to create a lifelong style.
2.6 Whilst we try to be as accurate as possible, all information provided on the website may be approximate and is provided in good faith.
2.7 This contract is covered by English law.
2.8 By placing an order with ‘motivum fashion’, you agree to and accept these terms as well as the terms of website use – please see section 8.
3. How to place order
3.1 You can use our website to place an order: www.motivumfashion.com
If you prefer to order by telephone or via email, just click on Contact us.
3.2 Postage will always be via Royal Mail postal services 1st class, no extra postage fee will be applied unless and only if you specify that you require your goods to be delivered by a specific way for example guaranteed, confirmed, tracked, signed for or via any other carrier company – in those cases, please let us know in the comment field and we’ll discuss it further and the payment of the extra fees, too.
3.3 You will be required to pay for the goods in full at the time of ordering.
3.4 We use secure payment facilities for online purchases. You can pay for your order by BACS or PayPal.
3.5 Promotional prices only apply during the period stated.
3.6 All prices quoted on our website are in UK pounds and include Value Added Tax at the current rate.
3.7 Once your order has been confirmed, changes may not be possible or may incur additional charges or delays.
3.8 Once your order is complete, we will notify you of the dispatch date.
4. Delivery Charges
4.1 Goods in stock will normally be dispatched within 2-3 working days and any estimated dispatch date is an estimate, which can change without notice.
4.2 The Royal Mail deliver goods 1st class normally within 2-3 working days of dispatch – please check online.
4.3 Your order may arrive in more than one delivery.
4.4 We can post the goods anywhere in the UK.
4.5 All delivery fee abroad, in Europe or America will have to be paid in advance, the extra fee will be e-mailed to you and you will need to pay before postage – the payments can be made via bank transfer or PayPal, please refer to the order number when paying.
4.6 Delivery in person can be agreed, please specify this in the comment section or contact us for further details. Extra charges may apply.
4.7 Disposal of packing materials is your responsibility.
4.8 It is not possible to change the delivery address once the goods have been dispatched to you.
4.9 Please check the goods on delivery, any goods found to be missing or damaged should be notified to us within a reasonable time.
4.10 If the goods are lost or damaged in transit, please let us know promptly.
4.11 Sometimes, for reasons beyond our control we may be prevented from dispatching your goods as planned. These might include things such as severe illness, accidents, breakdowns, fire, flood, storm, severe weather, acts of god, war, riot, civil commotion, malicious damage or any Vis mayor. We will try to put things right as soon as possible however we can’t be responsible where this causes a delay or failure in dispatching your goods.
4.12 Time is not the essence of the contract unless expressly stated otherwise in writing to us via e-mail: firstname.lastname@example.org
Goods not in stock:
If you order an item which is not in stock and needs to be custom made, we will contact you to agree on a timeframe and notify you when the item is ready to be dispatched. If the item is not in stock, you are still free to personalize your item or ask for changes agreed prior with us.
5. Cancellation and returns
5.1 You can cancel your contract at any time up to 14 days after the day of delivery. To do this, please e-mail us: email@example.com
We are unable to accept cancellations by phone.
5.2 You do not have to give any reason for cancellation. However, a brief explanation will help us to improve the service we offer to customers in the future.
5.4 If you cancel, you must return the goods within 14 days of cancellation, complete with the original packaging, not used and not worn, with all the tags and labels to us, at your own expense. You must ensure that the goods are packaged adequately to protect against damage – if the goods have been delivered to you without damage and returned damaged, unfortunately, you will not be refunded.
5.5 If you fail to return the goods, we will collect them, and we will charge you the direct cost of collection. If you fail to take reasonable care of the goods before or during they are returned to us, and this results in damage or deterioration, we will charge you for the reduction in value.
5.6 We will refund all monies paid to us by you within 30 days, less any costs due under this contract.
6. Faulty Goods / Guarantee
6.1 If there is a problem with the goods, please notify us by email or in writing providing details of the problem. It’s helpful if you can provide us with a digital photograph of the problem. We will deal with the matter in accordance with your legal rights.
6.2 If an exchange is necessary (item is not the right size, etc.), this will be arranged without unreasonable delay. Replacement goods will not be dispatched until the original goods have been received at our address and checked. You must send the goods back with original labelling, tags and not used/worn.
The cost of returning goods to us is your responsibility, however on inspection will refund your reasonable postage costs, providing that the goods are found to be faulty.
If the goods are not faulty, we will return them to you, however you will be required to cover our reasonable postage costs.
6.3 Guarantee cannot be provided to any of our goods as this depends on the usage:
Most of the fabric goods have to be washed in 30 degrees, iron in medium heat, do not tumble-dry, do not expose them to direct sunlight and do not mix light and dark coloured fabrics while washing – we cannot take any goods back as faulty if you don’t keep those recommendations.
6.4 However, you find that our goods are poor quality, please let us know to discuss it further as our aim to improve our services.
6.5 Within 14 days, if we have similar replacement goods in stock, we will replace defective goods free of charge, at our discretion, providing that you have returned to us any faulty goods upon request.
6.6 If an item is no longer available, we will try our best to offer an alternative. However, our liability will be to replace the faulty goods only and we are unable to guarantee an exact match. In this instance you will have the option of a refund.
6.7 Where we replace faulty goods, you are responsible for their disposal if they have not previously been returned to us.
6.8 We do all our best to guarantee the exact motives and colours but as this is creative and art, decoration may vary, and we are not always able to guarantee the exact colour match due to the nature of the product.
7. Authentic Hungarian Folk Art Guaranteed
We are taking full guarantee of all our goods in order that all are hand-made, authentically produced in accordance to the traditional folk art from Hungary and its historical boarders.
With all our best intention that our products sold on this website designed to comply with all relevant UK legislation, it might occur that, hand-made and following the authentic Hungarian Folk Art, some of our products may vary. We cannot warrant or represent that they comply with any legal requirement outside the UK.
